State leader of opposition Shaktisinh Gohil in an open letter to BJP national president Nitin Gadkari has said that he was holding the position of the president of the second largest political party. However, Gadkari’s statement on CBI inquiry showed that the BJP president did not have even elementary knowledge about facts.

Gadkari in his statement released today has said that CBI is not arresting any officer from Andhra Pradesh. “Were you not aware that Gujarat police had inquired into the case for three years”. The state government had put an officer of its choice and completed the inquiry and even filed the charge sheet. If you believe that AP police officers should have been arrested then why did Gujarat police did not do it while it conducted inquiry for three years? Gohil asked. Gadkari would have got the answers to his question if he had read the Supreme Court judgment before making such statements.

Gadkari must be aware of law of natural justice and cultural history of the country. Whenever there is atrocity on woman then the tormentor loses power. Ravan mistreated Sita and Lanka was destroyed. Kuaravas who were on winning spree brutally treated Draupadi, they had to face defeat.

        In the same way people who victimized Kauserbi are facing the nature’s punishment now. So BJP or its members should not support such people. Vibhishan parted way with Ravana because he was on evil path. Gadkari or his party also should not support Gujarat police or Gujarat BJP leaders.

When senior Congress leader Natwarsinh’s name came up in scandals then Congress instead of protecting him immediately parted ways with him. There are numerous such examples in public life. It is not proper to shield the BJP leader of the state who is accused of criminal conspiracy, Gohil said.

If CBI is doing something wrong or something wrong is being done on someone’s insistence then complaint should be made before Honorable Supreme Court. But this is not being done. This shows that CBI is doing nothing wrong and there is ample evidence against the accused.

You must be aware of the fact that head of CID crime, an officer of additional DG rank had in a letter to Chief Secretary on 1.8.2005 had said that Minister of State for Home Amit shah had taken a bribe of Rs.2.50 crore to release Ketan Parekh from jail, the accused in Rs.1600 crore Madhavpura co-op bank scandal.

Gujarat police could not conduct inquiry into this and it had to be done by the CBI. Still the Gujarat government did not take any decision about the inquiry. Crores of rupees of people are in this Madhavpura mercantile co-op bank which has its headquarters in the constituency of Lok Sabha leader L K Advani. The people whose money is in the bank are from Advaniji’s constituency. How can you shield Amit Shah who took bribe of Rs.2.50 crore to help the accused? This accusation against Amit Shah has not been made by the CBI but the additional DG of state police himself had submitted a written complaint.

The CBI inquiry in the case is not being done on the orders of central government or Congress. The Honourable Supreme Court conducted the hearing of the case for months and gave enough time to the state government to inquire into this. After three years the Supreme Court took cognizance of the Action Taken Report filed on eight affidavits and then the court ordered CBI inquiry to know whether it was part of a larger conspiracy or not? Was there any ulterior motive? What happened to ashes of Kauserbi? Was the third person Tulsi Prajapti or someone else?    

The CBI has to present the report in the Supreme Court and the whole matter is pending before the court. The Supreme Court had not to say like this in encounters in other states because in Gujarat many Hindus and Muslims were killed and in each encounter there was a story that a letter was found from the persons killed saying that they had come to kill Chief Minister Narendra Modi. The dead had taken terrorist training and country made revolver was found from him. Even a common man knows that a person who has taken terrorist training does not go with a country pistol and a killer does not keep a letter in his pocket.

The state government had to accept in the Supreme Court that encounter was fake. The state government blamed the police that it killed them for name and fame and promotion. However, what strikes anyone is the fact that Gujarat government did not give permission to police to go to Rajasthan to question Tulsi Prajapti while at the same time it transferred D G Vanzara as Banaskantha range DIG. Within seven days of the posting of Vanzara Tulsi Prajapati was brought in his jurisdiction and killed. As per the GAD rules the posting of a senior police officer cannot be done without the approval of Home Minister and Chief Minister. This itself shows that the government which is trying to put blame on police itself was a conspirator. Days before his encounter Tulsi Prajapati had written to NHRC expressing fears that Gujarat police would eliminate him.

I am sure that BJP president is aware of simple legal procedure that the chargesheet filed by CBI is against Abhay Chudasma while the name of Amit Shah is in column number 2. Charge sheet against Amit Shah is to be filed in 90 days as per the CrPC provisions.
